A federal judge has dismissed former President\u00a0<\/span>Donald Trump<\/span><\/a>\u2019s indictment in his classified documents case, finding that the appointment of special counsel Jack Smith by U.S. Attorney General Merrick Garland was unconstitutional.<\/p>\n<\/div>\n

U.S. District Judge\u00a0<\/span>Aileen Cannon<\/span><\/a>\u00a0<\/span>said in a ruling issued Monday that the appointment of Smith to prosecute the case ? which focuses on Trump\u2019s retention of classified government documents after leaving the White House ? violates the appointments clause of the U.S. Constitution.<\/p>\n<\/div>\n

That clause gives Congress \u201ca pivotal role\u201d in appointing certain government positions, which \u201ccannot be usurped by the Executive Branch or diffused elsewhere \u2014 whether in this case or another case, whether in times of heightened national need or not,\u201d Cannon wrote.<\/p>\n<\/div>\n

\n

President Joe Biden\u2019s son, Hunter Biden, was also prosecuted by a special counsel, prompting\u00a0<\/span>immediate speculation<\/span><\/a>from political pundits that his case could likewise be dismissed based on Cannon\u2019s ruling.<\/p>\n<\/div>\n

Peter Carr, a spokesperson for Smith\u2019s office, told HuffPost in a statement that the Justice Department has authorized the special counsel to appeal Cannon\u2019s order.<\/p>\n<\/div>\n

\u201cThe dismissal of the case deviates from the uniform conclusion of all previous courts to have considered the issue that the Attorney General is statutorily authorized to appoint a Special Counsel,\u201d Carr said.<\/p>\n<\/div>\n
